The rules for using elcara.xyz.

1. These terms

These terms are an agreement between you and Elcara L.L.C-FZ (“Elcara”, “we”, “us”), Meydan Grandstand, 6th floor, Meydan Road, Nad Al Sheba, Dubai, UAE. They apply when you use the website elcara.xyz and any service we provide through it (the “Service”).

By using the Service, you accept these terms. If you do not accept them, do not use the Service.

If you use the Service for an organisation, you confirm that you can bind it, and “you” includes it. You must be 18 or older. You confirm that you use the Service for your trade, business or profession.

If you have a signed agreement with us for a service, that agreement wins where it differs from these terms.

2. The Service

We may change, suspend or stop any part of the Service at any time, without notice. We may suspend or end your access at any time, for any reason, without notice.

3. Not advice

We provide marketing, content and technical services only. Nothing in the Service is financial, investment, legal or tax advice, or an offer or recommendation to buy, sell or hold any token or other asset. We are not an issuer, exchange, broker, custodian or financial adviser. We do not promise any listing, price, volume or result. Virtual assets carry high risk, including the loss of all value. You are responsible for your own decisions and for following the law that applies to your project.

4. Your use

You must not:

• break the law or anyone’s rights
• try to break into, overload or disrupt the Service or the systems behind it
• copy, scrape or harvest the Service or its content at scale, by robot or other automated means, without our written permission
• reverse engineer, decompile or copy any part of the Service
• send spam, malware or harmful code
• pretend to be someone else, or to be linked with us when you are not

5. Intellectual property

We and our licensors own the Service and everything in it, including text, data, design, logos and code. We give you a limited, non-exclusive, non-transferable right to use the Service under these terms. We can take this right back at any time.

If you send us ideas or feedback, we may use them freely, without paying you.

6. No warranty

The Service is provided “as is” and “as available”. To the extent the law allows, we give no promise of any kind about it, express or implied. This includes any promise that it is accurate, complete, secure, free of errors or fit for your purpose.

7. Our liability

To the extent the law allows:

• we are not liable for any indirect or consequential loss, or for any loss of profit, revenue, business, contracts, data, goodwill or opportunity
• our total liability for all claims together is limited to the fees you paid us for the Service in the 1 month before the event that caused the claim, or USD 10 if you paid nothing

Nothing in these terms limits a liability that the law does not allow us to limit.

8. Your indemnity

You will defend and compensate Elcara, its owners, staff and contractors for every claim, loss and cost, including legal fees, that comes from your use of the Service, or your breach of these terms or the law.

9. Time limit for claims

You must start any claim about the Service or these terms within 6 months after the event that caused it. After that, the claim is barred, to the extent the law allows.

10. Law and disputes

The laws of the Emirate of Dubai and the federal laws of the UAE govern these terms and any dispute about them or the Service.

Any dispute goes to final and binding arbitration under the Arbitration Rules of the Dubai International Arbitration Centre (DIAC). There is one arbitrator. The seat is Dubai, UAE. The language is English.

You may bring a claim only for yourself, not as a member or representative of a class or group. Claims of different users may not be joined.

We may also go to any court for an urgent order, to protect our intellectual property or to recover money you owe us.

11. Changes

We may change these terms at any time. The new version applies from the date we post it here. If you keep using the Service, you accept it.

12. General

We may transfer our rights and duties under these terms to anyone. You may not transfer yours without our written consent.

If any part of these terms is found invalid, the rest still applies. If we do not enforce a right at once, we can still enforce it later. We are not liable for delay or failure caused by events outside our reasonable control.

These terms, our privacy policy and any signed agreement with us are the whole agreement about the Service. If a translation differs, the English version applies.
